Probation Violations

Probation violations arise when a person who is on either formal or informal probation fails to maintain communication with the probation department, or fails to fulfill one of the terms of probation, such as completing anger management classes, community service, alcohol classes, or commits a new offense. If found to be in violation of probation, you may be sentenced to the maximum jail or prison sentence that could have been imposed for the underlying offense.

The possible penalty for a violation of probation varies from case to case, from county jail to state prison, and/or restitution, court fines, community service, formal or informal probation, and/or parole.

Warrants

Bench Warrants and Arrest Warrants are the most common types of warrants in California. An arrest warrant is a court order that permits law enforcement to arrest a person. Arrest warrants can be issued when law enforcement suspects an individual of being involved with, or having been involved with, a crime. Once an arrest warrant has been issued, law enforcement has the legal right to detain and arrest the individual in the arrest warrant.

A bench warrant is issued by a judge when an individual fails to appear in court. A bench warrant allows law enforcement to arrest an individual in order to bring them before the judge to appear in court on his/her pending criminal matter.
